End-User License Agreement (EULA) - FooCam

Effective Date: July 16th, 2025

These Terms of Service and End-User License Agreement (“Terms”, “EULA”) govern your use of the FooCam mobile application (the “App”), owned and operated by Land AI LLC (“Company,” “we,” “our,” or “us”).

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. By accessing or using FooCam, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Scope of License (Apple Requirement)

Land AI LLC grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App for your personal, non-commercial use solely on an Apple-branded product that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

2. Use of the App

FooCam is available worldwide and is intended for personal, non-commercial use. You may use the App only in compliance with these Terms and with all applicable local, national, and international laws. You are solely responsible for ensuring that your use of the App and its AI-based features is lawful in your location.

3. Account Registration

Some functionalities may require you to create an account. You agree to provide accurate and complete information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

4. Photography Coaching Disclaimer

FooCam provides automated AI photo analysis, feedback, and coaching recommendations. These features are for informational and educational purposes only and are not guaranteed to produce any specific improvement in photography skills. Results may vary based on user experience, equipment, shooting conditions, and other factors. The App does not provide professional certification, career advice, or legally recognized qualifications.

5. User Content

You may upload or submit content such as photos, notes, preferences, or feedback (“User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, display, and store that content solely for the purpose of operating, improving, and providing the App’s features. You represent that you own or have the necessary permissions for any content you upload. You may not submit content that is illegal, harmful, infringing, or violates the rights or privacy of others.

6. Prohibited Conduct

You agree not to:

  • Violate any local, national, or international laws.

  • Upload or share harmful, defamatory, or unlawful content.

  • Upload photos of others without proper consent, where required by law.

  • Attempt to interfere with, reverse-engineer, or disrupt the App.

  • Use the App in a manner that infringes on intellectual property or privacy rights.

  • Use automated systems or bots to access or interact with the App.

7. Intellectual Property

All content in the App—including software, text, graphics, analysis models, and design—belongs to Land AI LLC or its licensors. You may not copy, modify, distribute, or create derivative works without prior written authorization.

8. Subscriptions and Payments

Some features of FooCam may require a paid subscription. By subscribing, you agree to the pricing, billing cycle, and terms shown at the time of purchase. Payments and refunds are processed through third-party platforms (such as the Apple App Store) and are subject to their terms and policies.

9. Apple Minimum EULA Requirements

You and Land AI LLC acknowledge and agree to the following provisions required by Apple:

  1. Acknowledgement: You and Land AI LLC acknowledge that this EULA is concluded between Land AI LLC and you only, and not with Apple, and that Land AI LLC, not Apple, is solely responsible for the App and the content thereof.

  2. Maintenance and Support: Land AI LLC is solely responsible for providing any maintenance and support services with respect to the App. You and Land AI LLC acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

  3. Warranty: Land AI LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

  4. Product Claims: Land AI LLC, not Apple, is responsible for addressing any claims of the end-user or any third party relating to the App or the end-user’s possession and/or use of that App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

  5. Intellectual Property Rights: Land AI LLC will be solely responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights.

  6. Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

  7. Third Party Terms: You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).

  8. Third Party Beneficiary: You and Land AI LLC acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of the EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against you as a third party beneficiary thereof.

10. Disclaimer of Warranties

The App is provided “as is” and “as available.” We make no guarantees regarding accuracy of AI analysis, reliability, or suitability for any purpose. Use of FooCam is at your own risk. (Note: This disclaimer is subject to the warranty clauses in Section 9.)

11. Limitation of Liability

To the fullest extent allowed by law, Land AI LLC shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, loss of profits, or inability to use the App, even if advised of such possibilities.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if required by law. You may discontinue use at any time, but no refunds are provided unless required under applicable platform rules or law.

13. Changes to the Terms

We may update these Terms from time to time. If material changes occur, we will notify you within the App or through other means. Continued use of FooCam after the updated Terms become effective constitutes acceptance of the revised Terms.
